Halcy Terms of Use
These terms are an agreement between you and Buntikki Technologies Private Limited (“we”, “us”), the company that makes Halcy. They apply to the Halcy app on iOS and Android and to halcy.app. By creating an account or using Halcy, you agree to these terms and to the Halcy Privacy Policy, which explains what we collect and how we use it.
The short version
- Your journal is yours, and private. You own your photos and notes.
- Share only photos you took or have the right to share, of people who are happy to be in them.
- Nothing sexual, violent, hateful, harassing or dangerous. We act on reports within 24 hours and disable accounts that break these terms.
- You can decline any invitation, block anyone, and delete your account at any time.
1. Who can use Halcy
You must be at least 13 years old to use Halcy. If a higher minimum age applies where you live, you must be at least that age. You may not use Halcy if we have previously disabled your account.
2. Your account
- You sign in with Apple or Google. Keep that account secure: you are responsible for what happens in Halcy under your account.
- If you choose a @username, it must not pretend to be someone else, use someone else’s trademark, or be offensive. We may remove a username that breaks these terms.
- You can change your username under the limits shown in the app. A username you give up is held for 90 days before anyone else can take it.
3. Your photos and notes
You own the photos and notes you add to Halcy. You give us permission to store, copy, resize and process them (for example, to make thumbnails and remove location data), and to show them to you and to the people you choose to share them with, only so that we can run Halcy for you. This permission ends when you delete them or your account, except for the copies described in section 7.
We work hard to keep your photos safe, but no service is perfect. Keep your own copy of anything you can’t bear to lose: “Save to Photos” in the app adds your photos to your phone.
4. Sharing with other people
Once you choose a @username, you can tag people in a moment and keep circles with other people. Other people can see only your @username and your Halcy profile photo. They never see your name, your email address, your notes or your own calendar.
Anyone who knows your exact username can find you. Nobody can browse or search for people. If you turn off Let friends find me in the app, nobody can find, tag or invite you. Circles you are already in stay as they are.
5. What you may not share or do
- Share only photos you took or have the right to share, of people who are happy to be in them.
- Never share anything sexual, violent, hateful or harassing, or anything that endangers anyone, including yourself. Never share anything involving a minor that is not entirely innocent.
- Never share anything illegal, or anything that infringes someone else’s rights.
- Don’t use Halcy to bother anyone. Tags and invitations are for people you know. Don’t send spam.
- Don’t pretend to be someone else, use another person’s account, or try to get at anything that isn’t shared with you.
- Don’t interfere with Halcy, get around its limits or security, copy data out of it by automated means, or reverse-engineer it, except where the law allows you to.
6. Zero tolerance, reports and blocking
Halcy has zero tolerance for objectionable content and abusive behaviour. Anything someone shares with you can be reported, and anyone can be blocked, from the ··· beside it. A blocked person is not told. We review and act on reports within 24 hours. Content that breaks these terms is removed, and the accounts behind it are disabled.
7. Your controls, and copies
- Every invitation can be declined. Nobody is told you declined.
- When someone accepts a moment you tagged them in, a copy becomes part of their own calendar and belongs to them. It stays theirs even if you later delete your account.
- Photos you add to a circle stay in it until you remove them, leave the circle and choose to remove them, or delete your account. When you leave, you choose whether your photos stay in the circle, and you can save them to your phone first.
- If a circle’s owner removes you, your photos in that circle are deleted. Deleting a circle deletes all of its photos.
8. Ending your use of Halcy
You can stop using Halcy and delete your account at any time from the app (see how to delete your account).
We may suspend or disable your account, or remove content, if you break these terms, if the law requires it, or if it’s needed to protect other people or Halcy. We may change or stop any part of Halcy. If we ever close Halcy, we will try to tell you in advance so you can save your photos.
9. Halcy is provided “as is”
Halcy is free. We provide it “as is” and “as available”, and, to the extent the law allows, without any promise that it will always be available, uninterrupted or free of errors, or that it will suit a particular purpose.
10. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, profits or goodwill, arising from your use of Halcy. Our total liability to you for any claim relating to Halcy is limited to the greater of the amount you paid us for Halcy in the 12 months before the claim and ₹1,000. Nothing in these terms limits any liability that the law does not allow us to limit.
11. App stores
If you downloaded Halcy from Apple’s App Store, Apple’s standard Licensed Application End User License Agreement also applies. Apple and Google are not parties to these terms and are not responsible for Halcy or its support.
12. Governing law
These terms are governed by the laws of India. The courts at New Delhi, India have exclusive jurisdiction over any dispute arising from them or from your use of Halcy.
13. Changes to these terms
We may update these terms as Halcy changes. We’ll post the new version on this page and update the “Last updated” date above. If a change is significant, we’ll also tell you in the app. If you keep using Halcy after a change, you accept the updated terms.
